1. Scope

These General Terms and Conditions (GTC) apply to all contracts for participation in language courses and subscriptions concluded via the website Universum der Sprachen (universum-der-sprachen.com) between Dmytro Karika (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Participant").

3. Subject of the contract

The provider offers digital language courses (German as a foreign language) on a subscription basis. Depending on the chosen package, such as Basic or Intensive, the services include a certain number of live online lessons per month, as well as access to accompanying learning materials. Lessons take place online via Zoom or Google Meet.

4. Conclusion of the contract

  1. The presentation of the courses on the website does not constitute a legally binding offer, but rather an invitation to place an order.
  2. By clicking the "Order with obligation to pay" (or "Buy") button, the participant submits a binding offer to conclude a paid subscription.
  3. The contract is concluded as soon as the provider confirms the order by email or access to the course area is activated.

5. Prices, due date and subscription

  1. The prices stated at the time of ordering apply. All prices are final prices.
  2. This is a subscription. The course fee is due monthly in advance.
  3. Payment is processed automatically via the selected payment method (Stripe: credit card, Apple Pay, Google Pay, or PayPal).
  4. If a payment fails, for example due to insufficient funds, the provider reserves the right to suspend access to the course until payment is received.

6. Term and termination

  1. The contract is concluded for an indefinite period (subscription).
  2. The subscriber may cancel the subscription at any time at the end of the current billing month.
  3. Cancellation can be done directly in the customer account under "My Account" > "Subscriptions", or by email to the provider.
  4. Payments already made for the current month will not be refunded upon cancellation. Access will remain until the end of the paid period.

7. Access and technical requirements

Participants are responsible for providing the necessary technical equipment (internet connection, microphone, camera, and software such as Zoom) to participate in live lessons. Technical problems on the participant's end do not entitle them to a reduction in fees.

8. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days.

Note regarding the expiry of the right of withdrawal: The right of withdrawal for a contract for the provision of services expires prematurely if the provider has fully performed the service and only began performing the service after the consumer gave their express consent and simultaneously confirmed their awareness that they would lose their right of withdrawal upon complete fulfillment of the contract by the business.

9. Missed lessons and appointment cancellations

  1. Scheduled lesson times are binding. A free cancellation or rescheduling of a scheduled lesson is only possible up to 12 hours before the lesson is due to begin.
  2. If the cancellation occurs less than 12 hours before the start of the lesson, or if the participant fails to appear for the scheduled lesson, the lesson will be considered completed. The lesson will be charged in full or deducted from the monthly lesson allowance of the subscription.
  3. This regulation applies regardless of the reason for the cancellation or non-attendance, including illness, technical problems on the participant's end, or work commitments. In these cases, there is no entitlement to a refund or a make-up lesson.
  4. If the provider cancels a lesson, for example due to teacher illness, this lesson will be credited and rescheduled.

10. Copyright and usage rights

All course materials (PDFs, videos, exercises) are copyrighted. They may only be used by the participant personally. Distribution to third parties or publication is prohibited.

11. Liability

The provider is liable without limitation for intent and gross negligence. For slight negligence, the provider is only liable for breaches of essential contractual obligations, limited to foreseeable damages.

12. Dispute resolution and final provisions

  1. The laws of the Federal Republic of Germany shall apply.
  2. The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obligated to participate in dispute resolution proceedings.

How long does my contract run and how can I cancel it?

Your contract has an unlimited term and can be cancelled monthly via your customer account. Cancellation must be made before the end of the current billing month to prevent further charges. The right of withdrawal for services expires upon full performance of the contract.
